GDPR\UK-GDPR and EEA Data Subjects’ Rights
The European Union (EU) General Data Protection Regulation (“GDPR”) is a privacy law that affords certain rights relating to the personal information of individuals in the European Economic Area (“EEA”). The United Kingdom (“UK”)’s General Data Protection Regulation (“UK-GDPR”) is a similar privacy law that affords certain rights relating to the personal information of individuals in the United Kingdom. Specifically, if you are in the EEA or the UK, you have the following rights:
- Access. You have the right to request a copy of the personal information we are processing about you. For your own privacy and security, in our discretion we may require you to prove your identity before providing the requested information.
- Rectification. You have the right to have incomplete or inaccurate personal information that we process about you corrected.
- Deletion. You have the right to request that we delete personal information that we process about you, except we are not obliged to do so if we need to retain such personal information in order to comply with a legal obligation or to establish, exercise or defend legal claims.
- Restriction. You have the right to restrict our processing of your personal information where you believe such data to be inaccurate, our processing is unlawful or that we no longer need to process such information for a particular purpose, but where we are not able to delete the information due to a legal or other obligation or because you do not wish for us to delete it. In such case, we would mark stored personal information with the aim of limiting particular processing for particular purposes in accordance with your request, or otherwise restrict its processing.
- Portability. You have the right to obtain personal information we hold about you, in a structured, electronic format, and to transmit such data to another data controller, where this is (a) personal information which you have provided to us, and (b) if we are processing that data on the basis of your consent or to perform a contract with you and (c) the data is processed by automated means. Additionally, you have the right to require us to transmit such personal information directly to another controller, where technically feasible. This right is not applicable if it adversely affects the rights and freedoms of others.
- Objection. Where the legal justification for our processing of your personal information is our legitimate interest, you have the right to object to such processing on grounds relating to your particular situation. We will abide by your request unless we have compelling legitimate grounds for the processing which override your interests and rights, or if we need to continue to process the data for the establishment, exercise or defense of a legal claim.
- Withdrawing Consent. If you have consented to our processing of your personal information, you have the right to withdraw your consent at any time, free of charge. This includes where you wish to opt out from marketing messages (where we have previously requested your consent for these).
You will not typically need to pay a fee for access to your personal information (or to exercise any of the other rights). But we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances. Please also note that we may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
You can exercise your rights by contacting us as set out in the contact section below.
Additional information on your rights under the UK-GDPR is available in English from the United Kingdom’s Information Commissioner’s Office. For residents of other EEA countries, please see the website of your applicable Information Commissioner. If you are located in the EU and have a concern about our processing of your data, you may have the right to make a complaint to the appropriate data protection authority in the EU.
For the personal information that we collect from you, APi Group acts as a “controller” under the GDPR and UK-GDPR. As discussed above, we use data for a variety of different purposes.
